Man sues Hale County after wreck, claiming negligence

A Hale County man has filed a lawsuit in Perry County Circuit Court against the Hale County Commission, State Farm Mutual Automobile Insurance Company, and multiple unnamed defendants following an ATV accident in March 2024. The lawsuit alleges that the negligence of a Hale County employee resulted in property damage and physical injuries to the plaintiff, Chris Agnew.

According to the complaint, the incident occurred on March 18, 2024, when Agnew was operating an ATV on Sand Road near County Road 48 in Perry County. The complaint states that an unidentified driver, referred to as John Doe, was operating a vehicle owned by the Hale County Commission. The driver allegedly struck Agnew’s ATV, causing injuries and damages.

Agnew claims that the driver was acting within the scope of his employment with the Hale County Commission at the time of the incident. The lawsuit asserts that the Commission negligently entrusted the vehicle to the driver and failed to properly supervise and train its employees. Additionally, the suit alleges that State Farm, which issued an insurance policy to Agnew, has not fulfilled its obligation to cover the damages resulting from the accident.

The lawsuit includes multiple claims against Hale County, including negligence, wanton and reckless conduct, negligent entrustment, and negligent hiring, training, and supervision, as well as an uninsured motorist claim against State Farm. Agnew is seeking compensatory and punitive damages, as well as interest and costs.
