A Hale County grand jury has indicted Kenneth Brady Turner, 31, of Greensboro on two counts of capital murder in the June shooting death of Tyler John Michael Hoffa and on a separate misdemeanor charge of third-degree domestic-violence menacing, according to court records.
The capital counts allege Hoffa was killed with a firearm while he was inside a vehicle and that the deadly weapon was fired from or within a vehicle, violations of Alabama Code §13A-5-40(a)(17) and (a)(18). A second indictment returned the same day charges Turner with discharging a firearm, identified as a shotgun, into an unoccupied dwelling.
Turner was arrested Sept. 29 and booked without bond. The case was formally filed Oct. 1 and assigned to Circuit Judge Marvin W. Wiggins. An arraignment is scheduled for Thursday, Oct. 30, at 9 a.m. in Hale County Circuit Court.
The domestic violence/menacing count stems from an allegation that Turner pointed a firearm at his spouse, placing her in fear of imminent serious physical injury.
Court filings in a related civil case show that the spouse sought a divorce in late August and reported a protective order in place; she is seeking legal and physical custody of the couple’s two minor children and supervised visitation for Turner.
Capital murder in Alabama is punishable by death or life imprisonment without the possibility of parole. A defendant is presumed innocent unless and until proven guilty in court.
