STATE OF ALABAMA
PROCLAMATION
BY THE GOVERNOR

WHEREAS, the Alabama Legislature, at its 2024 Regular Session, enacted Act No. 2024-301 (HB302), proposing an amendment to the Constitution of Alabama of 2022;

WHEREAS, in conformity with Section 284 of the Constitution of Alabama of 2022, as amended, the Legislature has ordered an election by the qualified electors of the state upon such proposed amendment; and

WHEREAS, notice of this election, together with the proposed amendment, is required by law to be given by proclamation of the Governor, which shall be published once a week for at least four successive weeks immediately preceding the day appointed for the election;

NOW, THEREFORE, I, Kay Ivey, as Governor of the State of Alabama, do hereby give notice, direct, and proclaim that on Tuesday, November 5, 2024, an election will be held in the State of Alabama in the manner and form provided by law upon the following proposed amendment to the Constitution of Alabama of 2022:

AMENDMENT PROPOSED BY ACT NO. 2024-301
(a) All sixteenth section and indemnity school land that is owned in fee simple by the Franklin County School System, is located in Fayette County and Walker County, and is for the exclusive use of schools in the Franklin County School System, is vested in the Franklin County Board of Education. The board may manage, sell, lease, and control the land and any timber, minerals, or other natural resources of the land.

(b) Any proceeds generated from the sale of timber, minerals, or other natural resources of the land, or from the lease or sale of the land or its natural resources, shall be paid to the Franklin County Board of Education and deposited into the Franklin County Board of Education General Fund.

(c) It is the intent of the Legislature that this amendment supersede any other provision of this Constitution that may be construed as conflicting with this amendment as it relates to the land and the rights, power, and control thereof, and to the sale, lease, or other disposition of the land and timber, minerals, or other natural resources of the land, and any proceeds and interest earned therefrom.

(d) Upon ratification of this amendment, all proceeds realized from the sale, lease, or other disposition of the land or the sale of timber, minerals, or other natural resources of the land occurring before the ratification of this amendment, and held in trust by the State of Alabama, shall continue to be held in trust, and any proceeds and interest derived from those transactions shall be paid to the Franklin County Board of Education.

FURTHER, I proclaim and direct that this proclamation shall be published once a week for the four successive weeks immediately preceding Tuesday, November 5, 2024, in every county as required by law.

Project Scope of Work: Install electrical infrastructure to support Pond 44 at the Alabama Aquatic Biodiversity Center, Marion, AL. All work shall be done under applicable State Laws.

Bid Package: Contract Documents and Plans may be examined at Mills-Conoly Engineering, P.C. (8218 Old Federal Road, Montgomery, AL 36117). They can be obtained through Alabama Graphics’ website (www.algraphics.com) via the ALGX Plan Room eSuite Login tab, Job Name: Power Requirements to Pond 44. Paper copies of Bid Documents may be purchased upon non-refundable payment to Alabama Graphics. It is the responsibility of each bidder to obtain sufficient knowledge of the project to fully comply with the Instructions to Bidders and satisfy all other requirements of the complete Bid Documents. No consideration will be given for failure to do so. Bids must be submitted on proposal forms furnished in the Specifications.

The selected bidder must submit an executed Disclosure Statement, required by Act 2001-955 (Article 3B of Title 41, Code of Alabama, 1975), within 10 days of the award. The Disclosure Statement may be submitted with the sealed bid.

Pre-bid Conference: A mandatory pre-bid conference will be held on-site at 2200 Highway 175, Marion, AL 36756, on October 29, 2024, at 10:00 A.M. CST. All parties interested in bidding may attend or contact Paul Johnson at (334) 467-3325 for directions.

Submission of Bids: Sealed bids must be accompanied by a certified check or bid bond in an amount not less than five percent (5%) of the contract bid price, but not to exceed Ten Thousand Dollars ($10,000). No bids will be accepted after the time stated for receipt of bids.

Evaluation/Award: The award will be made to the responsible bidder quoting the lowest total cost to the Department. The Department reserves the right to compare specific items, at its discretion, to determine the lowest responsible bidder. It is anticipated that the award will be made within thirty (30) days of the bid opening.

Performance Bond: A performance bond in the amount of 100% and a Payment Bond in the amount of 100% of the contract price will be required of the successful bidder.

Laws / Ordinances: The Contractor shall observe and comply with all federal, state, and municipal laws, ordinances, rules, and regulations applicable to this project.

Open Trade: By submitting a bid, the submitter represents that neither they nor their business entity are engaged in a boycott of persons or entities based in or doing business with a jurisdiction where the State of Alabama can enjoy open trade, as defined in Act 2016-312.

Immigration / E-verify: In compliance with the Beason-Hammon Alabama Taxpayer and Citizen Protection Act, any business entity or employer that employs one or more employees must provide documentation establishing enrollment in the E-Verify program. The successful bidder will be required to acknowledge compliance with federal immigration laws.

Non-Discrimination: The Department of Conservation and Natural Resources does not discriminate based on race, color, religion, age, sex, pregnancy, national origin, genetic information, veteran status, or disability in its hiring practices, nor in admission to, access to, or operation of its programs, services, or activities.

General Information: For contracts over $100,000, the Contractor must be licensed as a General Contractor in Alabama. The Department reserves the right to reject any or all bids or waive any informalities in bidding. All responses are subject to the Alabama Open Records Act, Ala. Code § 36-12-40 (1975), as amended, and may be publicly disclosed upon request. Force Majeure: In a Force Majeure Event, DCNR reserves the right to terminate the Agreement without notice to the Concessionaire. Neither Party shall be liable or in breach due to failure to perform obligations from causes beyond control, including but not limited to acts of God, natural disasters, public health emergencies, and pandemics, including COVID-19.

Performance Time: 180 calendar days from the Notice to Proceed.

A public meeting will be held to review and gather comments on the Draft Watershed Plan and Environmental Assessment (Draft Plan * EA) for the Middle Alabama Watershed. This plan, developed by the USDA Natural Resources Conservation Service (USDA-NRCS) with support from Auburn University and the Alabama Soil and Water Conservation Committee, aims to expand agricultural irrigation in the area. The project seeks to increase irrigated farmland while minimizing any negative effects on the environment and cultural resources.

The purpose of these plans is to advise the U.S. Department of Housing and Urban Development, our residents, and the general public of our overall mission, goals, and objectives for serving the needs of low-income and very low-income families in the area. Modernization work performed includes new kitchen cabinets, new floor tile throughout the units (2 and 3 bedrooms) at Lincoln Heights, new wiring, new Carbon Monoxide detectors, new bath retrofit (new bathtub), plumbing, new painting, etc.

The Housing Authority has adopted a NO SMOKING POLICY and MUST BE 25 FEET AWAY FROM HOUSING AUTHORITY PROPERTY.

The Five (5) year and Annual Agency Plan covering 2024-2029 is currently being developed, and all relevant policies and planning materials are available for review at the Housing Authority Office located at 102 Cahaba Heights. This information is subject to public comment during regular business hours of the Housing Authority. You are invited to review this information and give your comments and suggestions. A public hearing on the plan will be held by the Board of Commissioners as referenced above. All public comments will be considered by the Commissioners for inclusion in the plan.
